Terms of Service

By accessing or using the Shresh Biz website (www.shreshbizz.com) and related services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Platform. These Terms apply to all visitors, registered users, and anyone else who accesses or uses the Platform. We reserve the right to update or modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

Shresh Biz provides an online platform for IT solutions and digital services, including but not limited to: custom web application development, e-learning platform development, bespoke mobile app development, domain registration (500+ TLDs), web hosting (shared, VPS, dedicated), digital marketing (Facebook Ads, Instagram, SEO), and NPR payment gateway integration. Service specifications, timelines, and deliverables are confirmed in writing prior to commencement of any project.

To access most features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at info@shreshbizz.com if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate your account if any information provided during registration proves to be inaccurate or if you violate any provision of these Terms.

Shresh Biz offers both project-based and subscription services. Payments are billed as agreed at the time of purchase or project engagement. All payments are processed securely. Prices are displayed in Nepalese Rupees (NPR) or USD as stated. Shresh Biz reserves the right to change pricing at any time, with reasonable advance notice provided to existing customers.

Refund Policy: For hosting and domain services, refunds may be requested within 7 days of initial purchase by contacting info@shreshbizz.com. Refunds will not be granted after the 7-day period or once a domain has been registered (as domain registrations are non-refundable with registries). For development projects, refund terms are defined in the individual project agreement.

You agree to use the Platform only for lawful purposes and in a manner consistent with all applicable laws and regulations. You must not:

• Copy, reproduce, distribute, or publicly display any proprietary content from the Platform without our written consent
• Use automated bots, scrapers, or data extraction tools to access the Platform
• Attempt to gain unauthorised access to any part of the Platform or its systems
• Upload or transmit any harmful, malicious, or offensive content
• Impersonate any person or entity
• Use hosting services to distribute spam, malware, or illegal content
• Use the Platform to engage in any commercial resale activity without prior written approval

All content on the Platform, including but not limited to text, graphics, logos, icons, and software, is the property of Shresh Biz or its content suppliers and is protected by applicable copyright and intellectual property laws of Nepal.

For custom development projects, ownership of the final deliverable is transferred to the client upon receipt of full payment, unless otherwise agreed in writing. Shresh Biz retains the right to display the work in its portfolio unless the client requests confidentiality.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for lawful purposes only.

Shresh Biz provides domain registration and web hosting services powered by ResellerClub and related infrastructure partners. By registering a domain or purchasing a hosting plan through our Platform, you also agree to the terms of our upstream providers.

We strive for maximum uptime but do not guarantee 100% availability of hosting services. Planned maintenance will be communicated in advance wherever possible. Shresh Biz is not liable for losses arising from hosting downtime or domain propagation delays outside our reasonable control.

To the maximum extent permitted under applicable Nepal law, Shresh Biz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to us during the three (3) months preceding the claim. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

The Platform and its content are provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Digital marketing results (e.g. ad impressions, conversions, ROAS) are estimates and may vary; Shresh Biz does not guarantee specific outcomes from marketing campaigns.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection and use of your data as described in our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of Nepal, including the Electronic Transactions Act, 2063 (2006) and the Consumer Protection Act, 2075 (2018), without regard to its conflict of law provisions. Any dispute arising from or in connection with these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Kathmandu, Nepal.

Shresh Biz reserves the right to terminate or suspend your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us at info@shreshbizz.com. Upon termination, your right to use the Platform immediately ceases.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 14 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
